Here’s What Netflix, Disney and Amazon Have to Say About Challenging the Government’s New Tobacco Rules

Netflix, Amazon, and Disney have raised objections to the Indian government’s new tobacco warning rules, stating that it would be impossible for them to implement. The Ministry of Health ordered the streaming services to incorporate static health warnings during smoking scenes within three months. According to a letter from the Internet and Mobile Association of India (IAMAI), representing the streaming giants, the new rules will impede on content creators’ freedom of expression. The new tobacco warning rules also require streaming companies to include at least 50 seconds of anti-tobacco disclaimers, including audio-visual components at the start and in the middle of each program. This would require these companies to edit millions of hours of existing Hollywood and Indian web content, which poses a practical impossibility. The companies suggested that content descriptors would be more effective, warning users with a label “smoking” in a video alongside its title at the beginning. Moreover, these platforms said that the warnings would adversely affect customer experience and deprive India of valuable content production. Activists have welcomed India’s new rules, saying that it would prevent smoking, with 1.3 million people dying each year from smoking-related illnesses.
