Government Moots Self-Regulatory Mechanism, Mandatory Verification for Online Gaming Firms

The government has introduced a proposal for a self-regulatory mechanism and mandatory verification for players and physical Indian addresses for online gaming companies. This comes as part of the draft online gaming rules that were published on Monday. It is important to note that online gaming companies will be subject to the new IT rules that were released in 2021 for social media platforms.

It is expected that online gaming platforms will adhere to the laws of the country, including those related to gambling, betting, and the legal age for entering into a contract. The purpose of these draft amendments is to address this requirement while also promoting responsible growth within the online gaming industry,” as stated in the notice.

In accordance with the draft amendments, online gaming intermediaries will be required to exercise due diligence as outlined in the rules. This includes making reasonable efforts to ensure that users do not host, display, upload, publish, transmit, or share online games that are not in accordance with Indian laws, including those pertaining to gambling and betting.

Under the draft rules, online gaming companies will not be permitted to engage in betting on game outcomes. The minister emphasized the principle laid out in the draft rules and stated that all permissible online gaming activities must be registered with a self-regulatory organization that adheres to the online gaming rules.

The minister added, “According to the principles outlined in the rules, wagering on the outcome of a game will not be allowed. All online gaming companies must register with the self-regulatory body, which will determine the necessary action to be taken in accordance with the rules.”

The draft rules also require companies to display a registration mark on all online games registered with a self-regulatory body. Additionally, companies must inform users about their policies regarding the withdrawal or refund of deposits, the process for determining and distributing winnings, fees and charges, and the KYC procedure for user account registration.

The notice explains that self-regulatory bodies will be registered with the Ministry of Electronics and Information Technology. These bodies will have the authority to register online games of members who are online gaming intermediaries and meet specific criteria. They will also be responsible for resolving complaints through a grievance redressal mechanism.

The Ministry of Electronics and IT has invited public comments on the draft rules until January 17.
