Young people who sued their state over climate change notch their first victory

A group of young individuals who took legal action against the state of Montana for violating their right to a clean environment have achieved a significant triumph today.

A state court has ruled in their favor, stating that the plaintiffs have suffered past and ongoing damages due to the state’s negligence in considering greenhouse gases and climate change. These injuries include harm to their physical and mental well-being, as well as their homes, properties, recreational activities, spiritual and aesthetic interests, cultural traditions, economic security, and happiness.

Montana’s constitution guarantees residents and future generations the right to a clean and healthful environment. The plaintiffs aimed to compel the state to remove a provision in the Montana Environmental Policy Act that prohibited officials from considering the impacts of climate change when approving new energy projects, as they argued that it violated their constitutional rights.

Now, the state may have to reconsider that provision. The ruling states that the state must either have the discretion to deny permits for fossil fuel activities if they result in greenhouse gas emissions that harm Montana’s environment and natural resources or infringe upon the constitutional rights of the state’s children and youth, or the permitting statutes themselves may be deemed unconstitutional.

However, it is expected that the judge’s decision will face legal challenges, potentially leading to the case being taken to the Supreme Court of Montana. In such a scenario, the plaintiffs would have to endure a lengthy legal battle before seeing any concrete policy changes.

If Held and the other plaintiffs succeed, the outcome of the Montana case could potentially set a precedent for similar climate lawsuits filed by young people in all 50 states. Four of these lawsuits, excluding those in Montana, are still awaiting resolution, including a case against Hawaii’s Department of Transportation that is anticipated to go to trial next year.
