Online Gaming: 28% GST on online gaming: FM Nirmala Sitharaman issues clarification

The Finance Minister, Nirmala Sitharaman, has provided clarification on the Goods and Services Tax (GST) on online gaming during the GST Council meeting. She stated that taxes will be applicable on the total funds deposited for playing online games, rather than on every bet made.

Additionally, she clarified that taxes for online gaming and casinos will be imposed at the entry level, rather than on each individual bet.

This clarification brings some relief to those who were unhappy with the previous decision to impose a uniform 28% tax on the full face value of online gaming, casinos, and horse racing.28% GST on online gaming starting from October 1
The implementation of the GST is scheduled for October 1. A review of this decision will be conducted six months after its implementation, as stated during a press conference after the 51st GST Council meeting.
“The implementation of the 28% GST on online gaming and casinos is expected to begin on October 1… This decision will be reviewed six months after its implementation. When I say six months, I am referring to the period following its implementation, not starting from today,” she explained.
The 28% taxation rate has been anticipated by gaming companies, as the Group of Ministers (GoM) had broadly agreed on the proposed taxes for these activities in a previous meeting.
There was no consensus, as Goa proposed to impose only an 18% tax on platform fees. Sitharaman noted that Delhi, Goa, and Sikkim have requested a review of the 28% tax on online gaming.
“The council has agreed today to conduct a review after six months on how the 28% GST rates on casinos and online gaming are being implemented,” added the Finance Minister.
During a previous meeting, Sitharaman clarified that the government’s intention is not to prohibit online gaming, casinos, or horse racing.
“Our intention is not to eliminate online gaming, casinos, or horse racing. However, these activities have become so complex that whichever route we take, transparency exists only to a certain extent, and after that, it becomes opaque,” she stated.
