The Supreme Court has announced that it will hear the cross-pleas of Google and the Competition Commission of India (CCI) on July 14th. These pleas challenge the verdict of the National Company Law Appellate Tribunal (NCLAT) regarding Google’s alleged anti-competitive practices in the Android mobile device case. The NCLAT had upheld a fine of Rs. 1,338 crore against Google but removed conditions that allowed third-party app stores on its play store. Both Google and the CCI have appealed against the NCLAT judgment. The Chief Justice and Justice P S Narasimha have adjourned the hearing to July 14th.
Earlier, the NCLAT upheld six of the CCI’s directions regarding Google’s anti-competitive practices. These directions included allowing users to choose their default search engine during device setup and preventing OEMs from being forced to pre-install a bundle of apps. The NCLAT asked Google to implement these directions and pay the fine within 30 days. However, it set aside four directions, including one related to app developers porting their apps easily onto Android forks. The NCLAT also rejected Google’s plea regarding the computation of the penalty and the violation of natural justice by CCI’s probe arm DG.
