China has recently introduced a set of all-encompassing regulations concerning generative artificial intelligence (AI) models, with a strong emphasis on upholding “core socialist values.” These regulations will exclusively apply to services provided to the public, as the authorities strive to foster the growth of this technology.
Developed by a consortium of Chinese regulators led by the Cyberspace Administration of China, these rules will be effective from August 15. The Chinese regulators have expressed their commitment to adopting an inclusive and cautious approach towards generative AI services. They will implement a graded regulatory framework to ensure effective oversight.
Under these regulations, all generative AI content services, including text, images, audio, and video, offered to the Chinese public will be subject to strict compliance.
Generative AI models are now required to adhere to “socialist values,” refrain from promoting violence or addiction among minors. The regulations specifically prohibit the generation of content that incites actions such as subversion of state power, overthrowing the socialist system, compromising national security and interests, tarnishing the country’s reputation, promoting secession, undermining national unity and social stability, terrorism, extremism, national hatred, ethnic discrimination, violence, obscenity, and pornography. It is crucial to ensure that AI models and chatbots do not disseminate harmful misinformation.
Furthermore, the regulations stipulate that service providers must not discriminate based on factors such as ethnicity, faith, country, region, gender, age, occupation, or health during algorithm design and training data selection. Additionally, they must respect intellectual property rights. The new regulations also encourage the innovative application of generative AI technology and the creation of positive and wholesome content.
These recent rules pertaining to generative AI adopt a more positive tone compared to the earlier draft released in April. The punitive clauses, which originally outlined fines ranging from 10,000 to 100,000 yuan for technology-related violations, have been eliminated.
However, as per the regulations, generative AI service providers are required to halt their operations and report any unlawful activities if they discover users utilizing their AI technology to generate illegal content on their platforms. Additionally, AI service providers must deploy safeguards to prevent minors from developing addictive habits associated with their services.
The Chinese regulators have made a commitment to support and encourage the development of this groundbreaking technology by implementing appropriate measures.
Presently, Chinese companies are not authorized to release ChatGPT-like services for public use. Baidu’s Ernie Bot and Alibaba’s Tongyi Qianwen are still in trial mode or exclusively available for business purposes. OpenAI’s ChatGPT and Google’s Bard are not accessible in China, and links to other foreign models are also blocked.
