Apple’s Appeal in Dispute With Optis Over 4G Patents Dismissed by London Court, Citing Infringement by iPhone and iPad Models

In a significant ruling on Tuesday, London’s Court of Appeal determined that Apple has infringed two telecommunications patents, which are utilized in their iPhones and iPads. This decision comes after a long-standing legal dispute between the tech giant and Optis Cellular Technology, a US patent holder.

The legal battle initiated in 2019 when Optis, based in Texas, filed a lawsuit against Apple, accusing them of using patents that are crucial to specific technological standards like 4G.

Last year, London’s High Court concluded that two of Optis’ 4G patents are classified as standard essential patents and declared that Apple had indeed infringed upon them.

In May, Apple lodged an appeal against the ruling, contending that the two patents in question were not essential to 4G standards, and that they had not violated the patents. However, the Court of Appeal dismissed Apple’s challenge, with Judge Colin Birss affirming that the High Court made the correct decision in rejecting Apple’s argument and acknowledging the importance of the patents.

Apple and Optis have yet to respond to requests for comment in light of this ruling.

This ruling is the latest development in the ongoing legal dispute between Apple and Optis, which has involved six separate trials and numerous appellate hearings in the UK alone since 2019.

In a previous ruling, the Court of Appeal upheld Optis’ appeal against the revocation of two other 4G-related patents. This decision, which took place in October, granted Optis the right to request an injunction against Apple to prevent further infringement while a court determines the fair, reasonable, and non-discriminatory terms of use.

Earlier this year, Apple received permission to appeal against the ruling made in October.
