Apple vs Epic Games: US Supreme Court refutes request to change App Store payment rules

The US Supreme Court has rejected a federal judge’s injunction that could have compelled Apple to make changes to its App Store payment practices. This decision deals a blow to Epic Games in their ongoing legal battle with Apple.

Epic Games attempted to expedite a revision of Apple’s App Store payment policies but failed in their efforts. The creator of Fortnite sought the support of the Supreme Court to overturn a decision by the US Ninth Circuit Court of Appeals, which delayed an injunction against Apple’s App Store rules. However, Justice Elena Kagan refused the request without providing an explanation.

Back in April, a US federal appeals court ruled in favor of Apple in a lawsuit filed by Epic Games over App Store policies. The court acknowledged that Apple had violated California’s Unfair Competition law by preventing third-party developers from directing users to alternative payment options. Following the trial, a lower-court judge issued an injunction to stop this practice. The Ninth Circuit Court of Appeals initially upheld the injunction in April but later suspended it in July, granting Apple a 90-day period to bring the case to the Supreme Court.

Epic Games urged the Supreme Court to overturn the Ninth Circuit’s decision, arguing that it would harm not only Epic Games but also numerous consumers and other app developers for an extended period of time.

Epic Games had accused Apple of being an illegal monopolist by mandating consumers to use its App Store and purchase digital content with a 30% commission.

Apple declared that it needs to modify its business model in order to comply with the injunction before the completion of the judicial review. The injunction restricts Apple’s ability to protect users from fraud, scams, malware, spyware, and objectionable content.

Epic Games is also confronting Google in a similar lawsuit, which is scheduled to go on trial in November. Like Apple, Google removed Fortnite from the Play Store for violating in-app payment guidelines.
