UK’s CMA Holds Power Once Again to Decide on Approval of Microsoft-Activision Blizzard Deal

Microsoft’s proposed acquisition of Activision Blizzard is once again under scrutiny by the UK’s antitrust regulator. An appeals court granted an adjournment, prompting the Competition and Markets Authority (CMA) to reconsider its decision to block the $69 billion deal. Microsoft has presented its arguments for reconsideration, emphasizing the binding commitments it made to the European Union, including a decade-long streaming agreement for Activision games and partnerships with Nvidia, Boosteroid, and Ubitus. The company believes these commitments address the CMA’s concerns and should merit approval. Microsoft also contends that the CMA’s proposed block extends beyond necessary measures, encompassing Activision Blizzard’s subsidiary, King, which produces mobile games like Candy Crush Saga. The CMA, however, considers the recent licensing deal between Microsoft and Sony irrelevant to its review. The adjournment has been provisionally approved by Britain’s Competition Appeal Tribunal, subject to further submissions from the involved parties. The CMA aims to reach a new provisional view on the deal by the week of August 7.
