Legal protection given to Shutterstock’s AI-generated artwork

Shutterstock has unveiled a plan to instill confidence in the use of AI by offering complete indemnification to enterprise users. Starting today, the renowned stock photo site will safeguard businesses against any legal claims that may arise from images created using its AI art generator, with human review confirmed for all images. This announcement closely follows a similar initiative by Adobe, which aims to introduce IP indemnity for businesses utilizing its generative AI platform, Firefly.

Now the question arises: should businesses be concerned? Shutterstock’s enticing offer of full indemnification for the license and use of generative AI images is designed to shield companies from potential legal disputes. This move is not surprising considering that Shutterstock’s AI-generated images do not undergo the same rigorous review and vetting process as traditional stock videos and photos on their platform. Without careful scrutiny and skillful use of graphic design software to edit potentially litigious images, businesses could find themselves entangled in legal battles. This undermines the two key benefits of using these tools: speed and cost-efficiency.

In simple terms, businesses not only desire but also require assurance that the AI-generated images they produce are legally sound. The major players in the generative AI space have recognized this fact. Jeff Cunning, Shutterstock’s Vice President of Product, stated, “This is a crucial advancement, not only for our platform but for the entire industry. Creative professionals and business leaders can now utilize AI-generated content from our platform for any purpose, commercial or personal, without concerns about copyright infringement or ethical issues. It’s a vital step in protecting our customers and artists.”

John Lapham, General Counsel at Shutterstock, echoed this sentiment, saying, “We are witnessing a pivotal moment in the use of generative AI technology. Business professionals are demanding more reassurance regarding their rights to legally utilize AI-generated content, while original content creators want to ensure fair licensing of their work.”

Following a successful trial of indemnified images with select customers, Shutterstock will now expand this protection to all enterprise users upon request.
